TERMS OF SERVICE

By commissioning me in any way, you acknowledge and agree to all terms below
I don't make commissions for commercial use, Personal use ONLY
Please read all policies below before reaching out to me.
Full payment upfront is required before I can start.
You must be 18+ to commission me.

1.- Artist-client relationship.
You as a client will commission me as an independent artist to create an original digital piece of the idea you have in mind (see drawing conditions), during this process I have the right to work with other clients at the same time and you will receive the final file in your email (png or gif), you are not buying anything physical.
Customer is placed in work queue when I receive payment.
There will be communication throughout duration of project until completion.
I have the right to decline or cancel a commission for any reason, and am not required to document or state that reason.

2.- Drawing Conditions.
TYPES OF CHARACTERS:
-Original characters:
I will draw any original character created by you or another artist that you have the rights*.
I can add the original artist's credits as the creator if you request it.
-Fictional characters:
I will draw a fanart of any existing fictional character as a tribute or depending on the situation as a parody with no intention of damaging the original work or award me the rights to the work or its author.
-Real people:
I will draw real people who give their consent* (You, your partner, friends, family, etc.)
*I will trust your word as a client about your ownership of the rights or consent, if it becomes the case that you do not have rights and I as an independent artist receive a claim, I will not be responsible for the case, I will limit myself to explaining the situation, removing the content if I have it public and facilitate the contact info of the client to the original artist privately if requested.
SITUATIONS:
I will not draw anything of a racist, political, religious nature or content that may incite hatred towards an individual or group of people.
NSFW content:
I will draw +18 content if its requested.
All the characters that I will draw Will be over 18 years old, even if the original character specifies that it is not and if it doesn't look like it since it is a representation created by me but it is not the original character.
I will draw some fetishes depending on my skills. (ask me)
You can freely talk to me about your idea for the commission, I will tell you whether or not I can work on it as long as it does not interfere with the above points.
All private conversations are confidential and I will not share them in any way.

3.- Prices
Prices listed are BASE prices and additional expenses may be applied for complex designs, additional props and number of characters.
Additional characters in one commission are 50% the cost of the full commission, per character. Up to four characters may be included in one commission.
Please refer to my social media for references of my stylization and techniques.
If a client requests a commission with a deadline, rush fees will be applied according to work queue and detail complexity.

4. Payment & Refunds
My accepted currency is USD (US Dollars) ONLY.
Payment will be made 100% upfront via PayPal
If we reach an agreement on the commission and price, I'll send you the invoice to your paypal where you'll make the payment. Any payment I receive outside of this request will be considered a tip.
No refunds will be made once payment is received even if you no longer want me to continue with the commission, they will only be made if I am not able to deliver the final work.

5. Work Process.
The client will contact me through any of my social networks by filling out the commission form.
After reviewing the form I will give the final price of the commission.
Once the commission is accepted, I will send a PayPal invoice to the email provided.
Once payment is confirmed, I will add you to my current work queue.
I will not start a commission until I have received any requested references.
I'll make the sketch based on the references and ideas I received, as soon as I finish it I will send it to you for you to review it and make the necessary corrections. Big changes can be made at this point.
With the approved sketch I will start with the lineart and color, at the end I will send it to your email in good quality with a basic background and no background in png. At this point you can make minor changes such as some detail that I omitted or color correction.
There is no estimated time of completion unless a timeline has been established by the client, pending rush fees.

6.- Privacy and rights.
By commissioning me, you are purchasing my artist labor only.
I am not to be held accountable for any controversy that comes from the commission.
Artist Rights:
I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce, or use the image for self-promotion.
I will respect your request to not publicly post your commission if you ask, no explanation necessary.
Commissioner Rights:
You as a client may claim the right of the character[s], but not the art itself, share it by any means, whether digital or printed and you may use it for any personal use, including but not limited to icons, signatures, layouts, wallpapers, themes, and personal site displays with PROPER CREDIT to the artist
You may not claim my artwork as your own, trace, or heavily reference [as determined by the artist] my work and claim it as your own.
You can also decide if you want your commission to be public or private, specify this before the commission ends, if you don't tell me anything I will assume it’s a public commission.
Public: Both you and I can freely publish the image, it will remain yours as a buyer but I can share it as an artist on my social networks*. The image will have my signature and links to my social networks covering some parts of the image when sharing it, the original image that I will send you will not have any of these.
In case of being a NSFW commission (+18) it will be published with censorship.
You can choose to be mentioned as a buyer when I share it, you just have to tell me before I publish it.
Private: The final commission will be sent only to the client.

TÉRMINOS DE SERVICIO

Al comisionarme de cualquier manera, reconoces y aceptas todos los términos a continuación.
No hago comisiones para uso comercial, SÓLO para uso personal.
Por favor, lea todas las políticas a continuación antes de ponerse en contacto conmigo.
Se requiere el pago completo por adelantado antes de que pueda empezar.
Tienes que tener 18 años o más para comisionarme.

1.- Relación Artista-cliente.
Tu como cliente me comisionaras como artista independiente para crear una pieza original digital de tu idea (ver condiciones de dibujo), durante este proceso tengo el derecho de trabajar con otros clientes al mismo tiempo que contigo y al terminar tu comisión recibirás el archivo final (png) en tu correo, no estás comprando nada físico.
El cliente es puesto en mi lista de trabajo cuando recibo el pago.
Habrá comunicación durante toda la duración del proyecto hasta su finalización.
Tengo derecho a rechazar o cancelar una comisión por cualquier motivo y no estoy obligado a indicar el motivo.

2.- Condiciones de Dibujo.
TIPOS DE PERSONAJES:
-Personajes originales:
Dibujare cualquier personaje original creado por ti o por otro artista del cual tengas los derechos*, puedo añadir los créditos del artista como creador original si así lo solicitas.
-Personajes Ficticios:
Dibujare un fanart de cualquier personaje ficticio existente como homenaje o dependiendo la situación como una parodia sin intención alguna de dañar la obra original ni adjudicarme los derechos de la obra o su autor.
-Personas Reales:
Dibujare a personas reales que den su consentimiento* (Tu, tu pareja, amigos, familiares, etc.)
*Confiare en tu palabra como cliente sobre tu propiedad de los derechos o consentimiento, si llega a ser el caso de que no los tengas y yo como artista independiente recibo un reclamo, no me haré responsable del caso, me limitare a explicar la situación, eliminar el contenido si lo tengo público y facilitar el contacto del cliente al artista original de manera privada si lo solicita.
SITUACIONES:
No dibujare nada de naturaleza racista ni contenido de carácter político, religioso o que pueda incitar al odio de un individuo o grupo de personas.
Contenido NSFW:
Dibujare contenido +18 si es solicitado.
Todos los personajes que dibujare tendrán 18 o más años, aun si el personaje original especifica que no lo es o si no lo parece, ya que es una representación creada por mí mas no es el personaje original.
Dibujare algunos fetiches dependiendo mis capacidades. (Pregúntame)
Puedes hablarme libremente sobre tu idea para la comisión, te diré si puedo o no trabajarla mientras no interfiera con los puntos anteriores.
Todas las conversaciones por privado son confidenciales y no las divulgare por ningún medio.

3.- Precios.
Los precios indicados son precios BASE y pueden aplicarse gastos adicionales por diseños complejos, artículos adicionales y número de personajes.
El precio extra por añadir un personaje adicional es del %50 de la comisión por personaje.
Se pueden incluir hasta 4 personajes en una sola comisión.
Por favor, consulte mis redes sociales para obtener referencias de mi estilo y técnicas.
Si un cliente solicita un encargo con una fecha límite, se aplicarán tarifas de urgencia según la lista de trabajo y la complejidad de los detalles.

4. Pago y Devoluciones.
SOLAMENTE se aceptan USD (Dólares Americanos) como moneda de pago.
El pago se realizará 100% por adelantado a través de PayPal
Si llegamos a un acuerdo sobre la comisión y el precio, te enviaré la solicitud a tu paypal donde realizarás el pago. Cualquier pago que reciba fuera de esta solicitud se considerará una propina.
No se harán devoluciones una vez recibido el pago aunque ya no quieras que continúe con el encargo, sólo se harán si no soy capaz de entregar el trabajo final.

5. Proceso de Trabajo.
El cliente se pondrá en contacto conmigo a través de cualquiera de mis redes sociales rellenando el formulario de comisión.
Tras revisar el formulario daré el precio final del encargo.
Una vez aceptado el encargo, enviaré una solicitud de PayPal al correo electrónico facilitado.
Una vez confirmado el pago, te añadiré a mi lista de trabajo actual.
No comenzaré la comisión hasta haber recibido las referencias solicitadas.
Haré el boceto basándome en las referencias e ideas recibidas, en cuanto lo termine te lo enviaré para que lo revises y hagas las correcciones necesarias. En este punto se pueden hacer grandes cambios.
Con el boceto aprobado comenzaré con el lineart y el color, al finalizar te lo enviaré a tu email en buena calidad con un fondo básico y sin fondo en png. En este punto puedes hacer pequeños cambios como algún detalle que haya omitido o corrección de color.
No hay un tiempo estimado de finalización a no ser que se haya establecido un plazo por parte del cliente, con el costo extra de tarifas de urgencia.

6.- Privacidad y derechos.
Al comisionarme solo me contratas como artista,
no me hare responsable de algún tipo de polémica que pueda proceder de alguna comisión.
Derechos de Artista:
Conservo todos los derechos de autor sobre mi trabajo que incluyen el derecho a distribuir, reproducir o utilizar la imagen para la autopromoción.
Respetare si quieres que tu comisión sea privada sin necesidad de explicaciones.
Derechos del Cliente:
Tu como cliente podrás reclamar los derechos de los personajes pero no del arte en si, tambien podrás compartirlo por cualquier medio ya sea digital o impreso y cualquier uso personal incluidos entre otros, iconos, firmas, diseños, fondos de pantalla, temas y pantallas de sitios personales con el DEBIDO CRÉDITO al artista.
No puedes adjudicarte mi obra, calcarla o referenciarla en gran medida y compartirla como propia.
También podrás decidir si quieres que tu comisión sea pública o privada, especificando esto antes de que termine la comisión, si no me dices nada asumiré que es una comisión pública.
Pública: Tanto tu como yo podremos publicar libremente la imagen, seguirá siendo tuya como comprador, pero puedo compartirla como artista en mis redes sociales*.
La imagen tendrá mi firma y links a mis redes sociales cubriendo algunas partes de la imagen al compartirla, la imagen original que te enviare no tendrá ninguna de las anteriores.
En caso de ser una comisión NSFW (+18) será publicada con censura.
Puedes elegir ser mencionado como comprador al momento de compartirla, solo tienes que comentármelo al momento de entregarte tu comisión.
Privada: La comisión final será enviada solo al cliente.
